1. Service Description
4POINT ("we", "us", "our") is a contractor matching service that connects Florida homeowners with licensed contractors for repairs related to 4 Point inspection findings. We are not an inspection company, insurance provider, or licensed contractor. We do not interpret inspection reports or provide insurance advice.
2. No Guarantee of Insurance Approval
Using our service does not guarantee that your insurance carrier will approve, renew, or issue a policy. Final repair requirements and coverage decisions are made solely by your insurer, inspector, and licensed contractor. We have no influence over underwriting decisions.
3. Contractor Relationship
Contractors matched through our service are independent licensed professionals. We do not employ, supervise, or control the contractors. Any agreement for repair work is between you and the contractor. We are not responsible for the quality, timeliness, cost, or outcome of any repairs performed.
4. Cost Estimates
All cost estimates shown on our platform are approximate ranges based on market data and publicly available information. Actual costs will vary based on your specific situation, location, scope of work, and the contractor you select. Estimates are provided for informational purposes only and do not constitute a quote or bid.
5. Information You Provide
By submitting your information through our intake form, you agree to provide accurate and truthful information. We use your information solely to facilitate contractor matching and will not sell your personal information to unrelated third parties.
6. Consent to Be Contacted (TCPA)
By submitting the intake form and providing your phone number, you give express written consent for 4POINT and its network of licensed contractors to contact you regarding your 4 Point inspection repair needs via phone calls, text messages (SMS/MMS), and/or email at the number(s) and address(es) you provided — including through the use of automated technology and prerecorded messages. This consent is not a condition of purchasing any service. Message and data rates may apply. Message frequency varies. You may revoke consent at any time by replying STOP to any text message or contacting us at support@failed4point.com. Your consent applies only to communications related to your submitted repair inquiry.
7. Uploaded Documents
Inspection reports, photos, and other documents you upload are stored securely and used only for the purpose of matching you with appropriate contractors. Uploaded documents may be shared with contractors we match you with so they can assess the scope of work. You represent that you have the right to share any documents you upload.
8. No Professional Advice
Nothing on this platform constitutes professional advice — legal, insurance, construction, or otherwise. Our educational content about 4 Point inspections, common issues, and repair processes is for general informational purposes only. Always consult with qualified professionals for advice specific to your situation.
9. Limitation of Liability
4POINT is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we are not liable for any damages arising from your use of our service, including but not limited to: contractor performance, repair outcomes, insurance decisions, missed deadlines, or reliance on information provided on our platform.
10. Privacy
We collect only the information necessary to match you with contractors: your name, contact information, ZIP code, and details about your inspection findings. We do not sell your personal information. Your data is stored securely using industry-standard encryption. You may request deletion of your data by contacting us.
11. No Endorsement of Contractors
Inclusion in our contractor network does not constitute an endorsement, recommendation, or guarantee of any contractor's work quality, licensing status, insurance coverage, or business practices. We verify that contractors hold active Florida licenses at the time of enrollment, but we do not continuously monitor their standing. You are responsible for independently verifying any contractor's credentials, insurance, and references before authorizing work.
12. Indemnification
You agree to indemnify and hold harmless 4POINT, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from: (a) your use of our service, (b) your interactions or agreements with contractors matched through our platform, (c) any dispute between you and a contractor, or (d) your violation of these terms.
13. Dispute Resolution
Any dispute arising from or relating to these terms or your use of our service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in the State of Florida in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against 4POINT.
14. Governing Law
These terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Florida.
15. Eligibility
You must be at least 18 years old and a legal resident of the United States to use our service. By submitting the intake form, you represent that you are the homeowner or an authorized representative of the homeowner for the property in question.
16. Changes to Terms
We may update these terms from time to time. Continued use of our service after changes constitutes acceptance of the updated terms. Material changes will be noted on this page with an updated effective date.
